Belgium has applied to intervene in the genocide case against Israel at the International Court of Justice, according to a report by Jurist.org. The application, lodged under Article 63 of the ICJ Statute, marks Belgium's formal entry into proceedings that have drawn declarations of intervention from a growing number of states since South Africa instituted the case in late 2023.
What is the underlying dispute?
The case before the ICJ alleges that Israel breached its obligations under the 1948 Convention on the Prevention and Punishment of the Crime of Genocide in its military operations in Gaza. South Africa filed the application on December 29, 2023, invoking Article IX of the Convention, which gives the Court jurisdiction over disputes concerning the interpretation, application, or fulfilment of the treaty.
The ICJ issued provisional measures on January 26, 2024, ordering Israel to take all measures within its power to prevent acts of genocide, to prevent and punish incitement, and to enable the provision of humanitarian assistance. The Court also ordered Israel to preserve evidence and report on its compliance.
What does intervention mean at the ICJ?
Article 63 of the ICJ Statute governs intervention by states parties to a convention whose construction is in question. The Registrar must notify such states, and each may intervene. The Genocide Convention's Article IX reserves interpretation to the Court, which has treated the clause as a jurisdictional gateway for third-party access.
A declaration of intervention does not make the state a party to the dispute, but allows it to be heard on the construction questions at issue. The Court may then draw upon the intervening state's submissions in its reasoning.
Who else has intervened?
Multiple states have filed declarations of intervention since South Africa instituted proceedings, including Nicaragua, Colombia, Mexico, and the Palestinian Authority. The list reflects the broad interest among the Convention's 153 states parties in the construction questions raised by the case.
What are the practical implications?
For practitioners, Belgium's intervention underscores the procedural openness of the ICJ to third-party participation in convention-construction disputes. An intervening state can file written submissions and, in some cases, oral pleadings on the legal questions, even without joining the merits.
Belgium's submission adds another voice to arguments about state obligations under the Convention, particularly the duties to prevent genocide and avoid complicity in its commission. The Court adjudicates independently of political considerations, though the diplomatic signal of intervention is unmistakable.
What comes next?
The ICJ will consider Belgium's declaration in due course. If accepted as admissible, Belgium may file a written statement and address the Court in oral hearings. The admissibility decision is not subject to appeal.
The principal case remains in its merits phase, with proceedings expected to continue through 2025. Belgium's intervention adds a procedural layer the Court must now manage alongside similar filings by other states.
