- EIOPA has launched a public consultation on outcomes-focused supervision of IBIP sales.
- IBIPs are insurance-based investment products — life insurance wrappers sold as investments.
- The approach shifts supervision from process compliance to measurable customer outcomes.
- Feedback is open to insurers, distributors, consumer groups and national regulators.

Europe's insurance regulator has opened a public consultation on outcomes-focused supervision of IBIP sales. The body behind it is EIOPA — the European Insurance and Occupational Pensions Authority, the EU agency that oversees insurance and pension markets from Frankfurt. The consultation targets how insurance-based investment products (IBIPs, meaning life insurance wrappers sold as investments) are sold across the bloc.
The move matters because it signals a shift in supervisory style. Regulators have traditionally checked whether firms completed the right forms and followed the right process. An outcomes-based approach asks a different question: did customers actually end up better off? Think of it like a restaurant inspector who stops reading the recipe and starts tasting the food.
What does the consultation cover?
EIOPA's paper sets out how supervisors should assess the results of IBIP distribution rather than the documentation around it. IBIPs sit at the intersection of insurance and investment law, so both national insurance regulators and securities-style conduct rules are in play. The consultation invites feedback from insurers, distributors, consumer groups and national competent authorities (the national regulators that EIOPA coordinates).
The practical stakes are straightforward:
- Distributors face supervision judged on measurable customer outcomes, not just compliant files.
- National regulators may need new data collection and assessment tools.
- Firms selling IBIPs across borders could see a more uniform supervisory lens applied through EIOPA's network.
The consultation runs as a public call for evidence, meaning anyone affected can respond before EIOPA finalises its approach.
Why does EIOPA care about outcomes now?
IBIPs have long attracted scrutiny because the buyer often cannot easily see what they pay for. A product can be technically well-sold and still leave the customer with poor value once fees, guarantees and surrender terms play out. Outcomes-focused supervision tries to close that gap by looking at real-world results — persistency, complaints, value for money — instead of relying on disclosure alone.
For practitioners, this consultation is an early warning. Firms that distribute IBIPs should watch it closely. If EIOPA's approach is adopted, supervisory reviews will likely demand evidence of customer outcomes, and firms without the data pipelines to prove good results will struggle to satisfy examiners.
The timing also fits a wider pattern. EU conduct regulators have spent the past decade tightening product governance and distribution rules, from PRIIPs disclosure to IDD (the Insurance Distribution Directive, the EU law governing how insurance products are sold). This consultation extends that arc from process to proof.
What happens next?
The consultation is open for responses, after which EIOPA will review the feedback and decide how to embed outcomes-focused supervision in its supervisory convergence work. That is the mechanism by which EIOPA pushes national regulators toward a common approach without making law directly.
For legal teams at insurers and distributors, the to-do list is short. Read the paper. Map which outcome metrics the supervisor could realistically request. Check whether current management information would survive that request. Firms that can already demonstrate customer outcomes will find the new supervisory world familiar; firms that cannot will need to build that capability before their regulator asks.
EIOPA has not yet set out the final shape of the framework, and the consultation outcome will determine how prescriptive it becomes. What is clear is the direction: supervision of IBIP sales in the EU is moving from what firms did to what customers got.
